Echoing this theme, the Assistant Treasurer has announced long-awaited development of mandatory service standards across core aspects of service delivery. The ATO has released a helpful tool for calculating the deductibility of fees for advice, and APRA has reissued two key superannuation reporting standards after finalising its data transformation project. An important decision from the Federal Court clarifies the importance of trustees pursuing merit review processes outlined in the SIS Act before seeking judicial relief. The Senate has scheduled the Better Tax Concessions bill for debate on Thursday 6th February – indicating a deal with the crossbench may finally have been reached

Meanwhile, enforcement actions shed light on best-practice approaches to BFID obligations, and the effect of SIS covenants in the context of a SFT – especially regarding conflict management and use of discretionary trustee powers.

It’s the most wonderful time of the year; annual report season! APRA has emphasised its firm focus on intensifying fund expenditure supervision; releasing its inaugural expenditure data report late this month. Several regulatory resources have been issued; notably a material service provider registration template, guidance on relief and no-action letters, and amendments to SPS114 Operational Risk Financial Requirements. The ATO concluded a significant enforcement action against the operator of a fraudulent early release scheme, and issued its annual compassionate early superannuation access data; observing a significant upward trend.

Plenty ado in Parliament this month, with super on parental leave and the climate risk disclosure framework passing both houses. The Economics References committee also returned its report into consumer experiences in retirement – recommending further consideration of using super for mortgage offset accounts.

APRA released annual performance test results and concluded an internal restructure. ASIC released its half-yearly enforcement update, with judgement handed down in several litigated matters. ASIC also adjusted wage inflation assumptions for calculators, issuing relief until December 31 this year.

The superannuation system continues to attract political attention, with legislative and regulatory activity initiated in relation to trustees with a relationship with CFMEU related entities that are the subject of allegations of misconduct.

Greenwashing enforcement activity remains prominent, with an important decision in the Federal Court and an update from ASIC on its enforcement activity.

As always, there were also technical but important changes. These involved transfer balance cap reporting and the formalisation of previously announced CPS230 transition relief for trustees of smaller funds.

The backlog of superannuation related Bills in Canberra has eased, with passage of legislation for the first tranche of Quality of Advice Review reforms receiving royal assent. The Objective of Super, Climate-related Financial Disclosures, and DIV 296 Tax Bills remain before Commonwealth Parliament.

Regulators didn’t escape Parliamentary attention, with the Senate Economics Committee recommending that ASIC be split into two and depend on penalties from its enforcement action as a source of funding and incentive for being tougher.

Final joint guidance from APRA and ASIC in relation to the Financial Accountability Regime was released, and changes to trustee strategic planning requirements under SPS515 were finalised and formalised.

mportant superannuation reforms were passed by both houses of Parliament, providing trustees with much needed certainty that Non-Arms’ Length Expenditure rules don’t apply to general expenditure. AFCA’s superannuation jurisdiction was also tweaked so that it isn’t exclusive.

The first tranche of the quality of advice reforms passed after some debate over whether trustee oversight obligations inferred a requirement to analyse each statement of advice in detail.

Treasury released its sustainable finance roadmap, APRA released several revised prudential standards (and finalised its CPG230 Operational Risk guidance), and the Federal Court handed down its judgement in a greenwashing case involving a superannuation fund, a decision that has important application to many trustees.
