Despite the calling of the election and commencement of caretaker conventions, consultations about legislation underpinning Payday Super and the delivery of Affordable and Accessible Financial Advice will proceed. APRA is also seeking feedback on changes to prudential standards related to board governance and appointments. ASIC has released its report into death benefit claims handling; making 34 recommendations across seven spheres of operation. This follows the commencement of a further landmark enforcement action against a major fund for untimely and ‘insensitive’ claims handling. In a separate judgement, the Federal Court has ruled that regulator proactivity and member returns are not grounds for discounting the principle of general deterrence when determining penalties for severe and systemic misconduct.
